Apple vann mot Samsung

I den största rättegången i historien av stämningar mellan teknikföretag gick Apple Inc. segrande ur striden. Inatt kom domen som dömer Apple till vinnare.

Bilden ovan sammanfattar den grundläggande historian bakom den här rättegången som pågått i över tre år. Diverse övriga patent-tvister och stämningar har tillkommit och sammanfattas i bilden nedanför.

Och idag kom alltså domen som ger Apple del i nästan alla punkter(utom stämningarna som handlade om Samasungs platta Galaxy Tab 10.1 - där vinner Samsung). Apple får 1.049 miljarder US dollar av Samsung i skadestånd och Samsung får ingenting. Nedan följer ett händelseförlopp under domens slutförande:

- Samsung guilty on bounce back.

- Samsung infringes on pinch to zoom on all but three devices.

- Apple’s patent for iPhone’s front surface violated on all but one phone.

- Two Samsung phones violated the back of the iPhone.

- Samsung violated with all phones on the iPhone home screen patent.

- Samsung Galaxy Tab design does NOT INFRINGE the Apple iPad’s design, per the Jury.

- Jury says Apple patents were willfully infringed by Samsung (5 out of 7 places).

- Jury finds that all of Apple’s patents ARE VALID.

- Damages to Apple $1,051,855,000

- iPhone 3G, 3GS, and 4, iPad and iPod touch don’t infringe any Samsung patents.

- AAPL up: 670.90‎ +7.68‎ (1.16%‎)

- Apple has to pay Samsung $0

- Apple has infringed no Samsung products.

- AAPL up: 672.75‎ +9.53‎ (1.44%‎)

Och alltså segrade Apple på nästan alla punkter. Efter domen kom uttalanden från de båda teknikjättarna:

Apple's pressmeddelande

"We are grateful to the jury for their service and for investing the time to listen to our story and we were thrilled to be able to finally tell it. The mountain of evidence presented during the trail showed that Samsung’s copying went far deeper than even we knew. The lawsuits between Apple and Samsung were about much more than patents or money. They were about values. At Apple, we value originality and innovation and pour our lives into making the best products on earth. We make these products to delight our customers, not for our competitors to flagrantly copy. We applaud the court for finding Samsung’s behavior willful and for sending a loud and clear message that stealing isn’t right."

Samsung's pressmeddelande

"Today's verdict should not be viewed as a win for Apple, but as a loss for the American consumer. It will lead to fewer choices, less innovation, and potentially higher prices. It is unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners, or technology that is being improved every day by Samsung and other companies. Consumers have the right to choices, and they know what they are buying when they purchase Samsung products. This is not the final word in this case or in battles being waged in courts and tribunals around the world, some of which have already rejected many of Apple's claims. Samsung will continue to innovate and offer choices for the consumer."

Efter domen kommer troligtvis föreläggningar och överklaganden med start den 29:e september.
